Grievance against Brand-Specific and Restrictive Technical Specification
The bidding document mandates “Medisol” for Normal Saline 1000 ml and expressly provides that “any other company/product will not be accepted.” Such restriction to a single brand/manufacturer appears inconsistent with Rule 10 of the Public Procurement Rules, 2004, which requires specifications to ensure the widest possible competition and provides that technical specifications shall be generic and shall not favour any particular supplier.
Where reference to a brand is considered essential, the Rules require due justification and the use of “or equivalent”, with clear and objective parameters for determining equivalence.
It is, therefore, respectfully requested that the Procuring Agency may amend the specification by removing the exclusive requirement of Medisol and prescribe generic technical, quality and applicable regulatory requirements, enabling all compliant products/manufacturers to compete on an equal basis. Alternatively, the specification may state “Medisol or equivalent” with clearly defined equivalence criteria.
The grievance is submitted under Rule 48 of the Public Procurement Rules, 2004, with the request that the restrictive condition may kindly be rectified before the bid submission deadline to ensure fair, transparent and competitive procurement in accordance with Rules 4 and 10.
