Respected Sir/Madam,

We respectfully submit this grievance regarding the exclusion/non-availability of Insurance Guarantee / Insurance Bond as a form of Performance Security in the subject procurement.

Our repeated clarifications specifically sought confirmation whether this exclusion is:

(i) based on any specific prohibition/restriction under the applicable PPRA Rules, regulations, notification or instruction; or

(ii) merely a limitation/configuration of the EPADS 2.0 system.

However, no specific PPRA Rule, notification or instruction has been identified in response, and we have instead been advised to consult the EPADS/PPRA Team.

We respectfully submit that a system configuration should not, by itself, determine or restrict a bidder’s substantive eligibility to provide a permissible form of Performance Security, unless such form is specifically prohibited or excluded under the applicable procurement framework.

This is particularly relevant as recent NBP Engineering Wing tender documents have expressly provided Bank Guarantee OR Insurance Bond as alternative forms of Performance Security.

We therefore respectfully request the Grievance Redressal Committee to clarify:

What specific PPRA Rule, regulation, notification or NBP procurement provision prohibits Insurance Guarantee/Insurance Bond for this procurement?
If no such prohibition exists, whether the exclusion in P88450

Request for Training Session and Clear Guidelines Regarding Tender Document Requirements

Dear Sir,

I would like to respectfully request that clear and comprehensive guidelines may kindly be provided regarding the completion and submission of tender documents, particularly with respect to which pages/forms are required to be filled, which documents are mandatory, and which documents may be skipped or are not applicable.

I have been participating in NBP tendering since 2009, and throughout this period, I have not previously been declared technically non-responsive. However, in the last six tenders in which I participated, I was declared technically non-responsive despite submitting the relevant documents.

As per my understanding, the following documents are generally important for technical qualification:

1. Valid PEC Certificate
2. Active Taxpayer Certificate (FBR)
3. Active PRA Certificate
4. Relevant Work Orders and Completion Certificates
5. Bank Statement / Audited Financial Reports
6. Required Affidavits on Stamp Paper
7. Employee List and Technical Staff Details
8. Work-in-Hand and Work-Done List

Despite submitting the above-mentioned documents, I have been declared non-responsive in recent tenders. Therefore, I humbly request that the exact reasons for technical non-responsiveness may kindly be clarified.

Furthermore, I would sincerely appreciate it if NBP could arrange a training/awareness session for contractors regarding the tendering procedure, particularly E-PADS and the latest Standard Bidding Documents (SBDs). The session may cover the following:

- Mandatory documents required for technical qualification
- Proper completion of all tender forms and pages
- Which pages/documents are required to be filled and which can be skipped
- Common reasons for declaring a bidder technically non-responsive
- Requirements of the latest SBDs
- Proper submission/uploading of documents on E-PADS
- Any other documents or requirements that contractors frequently miss

The purpose of this request is to ensure that contractors fully understand the tender requirements and can submit their bids correctly without any unintentional omission or misunderstanding.

I would be grateful if a training session or detailed written guidelines could kindly be provided for the benefit of contractors.

However, for the record, our specific query remains unanswered. We had requested clarification on whether the non-availability/exclusion of Insurance Guarantee as a form of Performance Security is:

(b) merely a limitation/configuration of the EPADS 2.0 system.

Since no specific PPRA Rule, regulation, notification or instruction has been identified in your response, we understand that the matter may appropriately be taken up with the EPADS 2.0 / PPRA Team for a definitive clarification.

Clarification – Missing Tender Drawings

It is respectfully submitted that no relevant drawings appear to be attached/provided with the subject bidding documents, although the BOQ repeatedly refers to execution “as per drawings.”

Rule 23(1) of the Public Procurement Rules, 2004 requires bidding documents to be precise and unambiguous, while Rule 23(2)(f) provides for specifications and drawings or performance criteria, where applicable.

In the absence of the relevant architectural and electrical drawings, bidders cannot accurately assess quantities, routing, dimensions and other requirements necessary to quote realistic and justifiable rates.

Kindly provide the relevant drawings forming the basis of the BOQ and scope of work so that all bidders may prepare their bids on a clear, accurate and comparable basis.

We understand from your response that the available Performance Security options in EPADS 2.0 have been prescribed/configured by PPRA. However, our specific query remains unanswered.

Kindly clarify whether the exclusion of Insurance Guarantee from the available options is due to (i) a specific prohibition under the PPRA Rules/regulations, or (ii) merely a system/configuration limitation of EPADS 2.0.

If it is a regulatory requirement, kindly identify the specific PPRA Rule, regulation, notification or instruction prohibiting/ excluding Insurance Guarantee as Performance Security. If it is only a system limitation, kindly clarify the procedure or authority under which an otherwise permissible form of Performance Security may be considered.

We may then approach the relevant PPRA/EPADS team with the matter on a specific and precise basis.

Thank you for the clarification. However, the response appears to identify the formats available in EPADS 2.0, but does not clarify the specific basis for excluding Insurance Guarantee from the present tender.

Kindly clarify whether EPADS 2.0 itself prohibits the Procuring Agency from accepting an Insurance Guarantee as Performance Security. If not, please identify the specific PPRA provision, NBP policy, circular, notification or competent-authority approval under which Insurance Guarantee has been excluded from this tender.

This clarification is particularly relevant as PPRA itself has clarified that the type of guarantee is to be prescribed by the Procuring Agency in the bidding documents and that there is no bar to obtaining an Insurance Guarantee from a supplier.

It is therefore requested that the specific basis for the present exclusion of Insurance Guarantee may kindly be provided.

“Rule 39 itself does not prescribe Bank Guarantee as the exclusive form of Performance Guarantee. Furthermore, PPRA’s own FAQ clarifies that there is no bar to obtaining an Insurance Guarantee from the supplier. Therefore, kindly clarify whether the exclusion of Insurance Guarantee from the present tender conditions is based on any specific PPRA notification, amendment, circular, NBP policy, or competent authority approval issued after the previous procurements in which Insurance Guarantee was accepted.”
