Grievance Regarding Performance Guarantee / Performance Security

A clarification and grievance regarding the Performance Guarantee / Performance Security requirement has already been raised in the NBP Islamic Banking Branch, Civic Centre Township tender. The same or substantially similar Terms & Conditions appear in other NBP branch tenders as well.

Since the underlying Performance Guarantee / Security condition is essentially the same, requiring bidders to raise identical clarifications and grievances separately for every branch tender may result in unnecessary repetition.

It is therefore respectfully requested that the clarification and substantive grievance already raised on this issue may kindly be considered consistently for all NBP branch tenders containing the same Performance Guarantee / Performance Security condition, while ensuring equal treatment of bidders.

Where any particular tender contains a materially different condition, threshold or applicability, the matter may of course be considered separately.

Request for Clarification Regarding BOQ and Bid Quotation Submission Mechanism on EPADS 2.0

There appears to be some confusion regarding the submission of the financial bid on EPADS 2.0.

In the bidding documents, two BOQs are provided: one BOQ contains the estimated cost, while the other is required to be filled in by the bidder. Furthermore, under the “Bid Quotation” section on EPADS 2.0, the financial bid is to be submitted through the Above/Below Percentage mechanism.

However, in the Annexure section, a separate “BOQ” is shown under Financial Submission (Vendor) with a requirement to upload the BOQ by the vendor, as evident from the attached screenshot.

This creates ambiguity regarding the correct method of submitting the financial offer. Therefore, it is requested that the Procuring Agency kindly clarify which mechanism will be considered for evaluation and acceptance of the financial bid:

Whether the bidder is required to submit the Above/Below Percentage through the “Bid Quotation” section; or

Whether the bidder is required to fill and upload the BOQ separately in the Annexure section; or

Whether both submissions are mandatory and, if so, how the quoted rates/percentage will be considered in case of any discrepancy.

It is requested that clear instructions may kindly be provided before the closing date of the bidding, so that bidders can submit their financial proposals correctly and avoid any possibility of rejection due to ambiguity in the EPADS 2.0 submission process.

Dear Sir,

While reviewing the tender documents for NBP IBB Civic Center, Township, Lahore, we have noted that the tender documents do not contain/identify any relevant architectural, civil, electrical, plumbing, HVAC or other detailed drawings for the proposed works.

Without the relevant drawings, it is difficult for the bidder/contractor to properly study the proposed work, understand the site requirements and prepare a proper technical assessment/research for execution and costing.

You are therefore kindly requested to provide/attach all relevant drawings with the tender documents, so that the scope of work can be properly studied and evaluated before submission of the bid.

since the project is for major renovation of an existing branch(and not new construction), no structural or detailed MEP working drawings are required. as per statndard practice, the approved layout plan together with detailed BOQ and technical specifications fully define the complete scope of work. The bidders may carry out a physical site visit of existing premises to assess field conditions to understand the scope and nature of the work before submission of their bids.

Thank you for the clarification. However, the response appears to identify the formats available in EPADS 2.0, but does not clarify the specific basis for excluding Insurance Guarantee from the present tender.

Kindly clarify whether EPADS 2.0 itself prohibits the Procuring Agency from accepting an Insurance Guarantee as Performance Security. If not, please identify the specific PPRA provision, NBP policy, circular, notification or competent-authority approval under which Insurance Guarantee has been excluded from this tender.

This clarification is particularly relevant as PPRA itself has clarified that the type of guarantee is to be prescribed by the Procuring Agency in the bidding documents and that there is no bar to obtaining an Insurance Guarantee from a supplier.

It is therefore requested that the specific basis for the present exclusion of Insurance Guarantee may kindly be provided.

Kindly clarify the legal and policy basis for prescribing Bank Guarantee as the sole form of Performance Security in this tender while excluding Insurance Guarantee. PPRA Rule 39 does not appear to prescribe Bank Guarantee as the exclusive form of Performance Guarantee, and PPRA has also clarified that there is no bar to obtaining an Insurance Guarantee from a supplier.

It is also pertinent that Insurance Guarantees issued by insurance companies are presently being accepted in ongoing NBP Engineering works. Therefore, kindly clarify whether any specific PPRA provision, NBP policy, circular, notification or competent authority approval requires the exclusion of Insurance Guarantee from this tender.

Dear Sir/Madam,

We have noted that there appear to be two BOQs in the tender documents:

The first BOQ, from pages 43 to 121, contains an estimated cost and covers Civil, Plumbing, Electrical, Air Conditioning (ACs), and Furniture works.

The second BOQ, from pages 200 to 244, does not contain any estimated cost and appears to cover the works only up to the Electrical portion.

In view of the above, kindly clarify which BOQ is to be considered for the submission of our quotation and how the rates are required to be filled/submitted.

Specifically, please confirm whether bidders are required to:

Fill in rates against the BOQ from pages 43 to 121; or

Fill in rates against the BOQ from pages 200 to 244; or

Fill in rates in both BOQs, if both are required for submission.

Your clarification will help us ensure that our financial quotation is submitted in the required format and in accordance with the tender requirements.
