Subject: Grievance under Rule 48 of Public Procurement Rules, 2004 against Discriminatory Eligibility Condition in Tender Ref. No. P55703 (Outsourcing of Janitorial, Museum Attendant & Electrician Services)
Respected Sir,
The undersigned respectfully submits this grievance under Rule 48 of the Public Procurement Rules, 2004 against the bidding documents issued for Tender Ref. No. P55703 regarding Outsourcing of Janitorial, Museum Attendant & Electrician Services.
The bidding documents prescribe that only SECP Registered Companies is eligible to participate in the procurement process.
With utmost respect, it is submitted that the above condition is discriminatory, unreasonable and contrary to the fundamental principles of public procurement for the following reasons:
1. The Public Procurement Regulatory Authority (PPRA) Rules are based on the principles of fairness, transparency, economy and maximum competition. Eligibility conditions should facilitate competition instead of unnecessarily restricting it.
2. Janitorial and manpower outsourcing services can lawfully be provided by Companies, Partnership Firms, Sole Proprietorships and Associations of Persons (AOPs). These business entities are recognized under the laws of Pakistan and are legally competent to enter into contracts with Government Departments.
