Grievance Regarding Restrictive Tender Condition

Respected Sir/Madam,
I am writing to formally lodge a grievance under Rule 50 of the Public Procurement Rules (2004) regarding a condition specified in the tender documents for "DEMOLITION OF SHEDS AT J-BOND AT KPT HEAD OFFICE". The clause in question requires bidders to have a minimum of 10 years’ experience in Maritime Structures Demolition / Buildings at Port Area.
While we fully appreciate the importance of relevant experience in ensuring safety and quality, we respectfully submit that the stipulation of a blanket 10-year minimum is excessively restrictive and may conflict with the principles of fair competition enshrined in Rule 4 of the PPR 2004. Capable and qualified firms with proven expertise but fewer years of operation are unfairly excluded, which undermines transparency and value for money.
We therefore request the Committee to kindly review this condition and consider revising it to a proportionate and reasonable threshold that ensures both safety and competitiveness. This will allow broader participation and uphold the spirit of the PPRA framework.
We trust the Committee will address this matter in accordance with the rules and provide a fair resolution.
