Request for Clarification - PPRA Security Services Tender Regarding Non-Compliance with Labour Laws, the PPRA Rules, 2004, and E-Pak Procurement Regulations, 2023

With reference to the Bidding Document issued by the Federal Public Procurement Regulatory Authority (PPRA) and published on the PPRA e-PADS v2.0 Portal under Tender No. P-53225 on 02-07-2026, with bids scheduled to be opened on 20-07-2026, for the procurement of "Procurement of Security Services," it is respectfully submitted that several provisions of the Bidding Document are inconsistent with the applicable labour laws, the regulatory framework governing private security companies, and the Public Procurement Rules, 2004 (PPRA Rules, 2004). Clarification is therefore sought on the following matters:

1. Under Rules 4 and 23 of the PPRA Rules, 2004, the Procuring Agency (PA) is required to conduct procurement in a fair, transparent and competitive manner and to prepare clear, complete and unambiguous bidding documents. However, the present 72-page Bidding Document is vague, internally inconsistent and incapable of ensuring a fair, transparent and competitive procurement process.

It further omits several mandatory statutory requirements, contains provisions that are ultra vires the powers of the PPRA, and is inconsistent with the regulatory framework governing private security companies, the applicable labour laws and the PPRA Rules, 2004. It also requires audits and verification of bidders beyond PPRA's statutory mandate, which is limited to evaluating bids against the prescribed eligibility, qualification and evaluation criteria.
